NWMLS asks court to dismiss Compass lawsuit

The Northwest Multiple Listing Service asked a court to dismiss Compass’s lawsuit against it, arguing that the allegations it is “anti-competitive” fly in the face of over 40 years of service to the local real estate industry.

The lawsuit, announced on April 25, called NWMLS a “monopolist” and alleged that the organization’s practices threaten homeowner choice in the United States.

NWMLS originally responded to the lawsuit shortly after it was filed, denying Compass’ claims and firing back at the brokerage’s private listing network model.

NWMLS’s petition to dismiss the case comes just days after the news that Compass is also suing Zillow, the latest development in the brokerage’s pursuit to preserve its Compass-exclusive listing option.

“Compass voluntarily agreed to follow NWMLS’ rules. When Compass decided on a new business strategy, it demanded that NWMLS alter its longstanding rules to conform to Compass’ new strategy,” a spokesperson for NWMLS said in a news release. “By demanding access to others’ listings while claiming a right to deprive other member brokerages of its own listings, Compass’s complaint confirms the pro-competitive nature of NWMLS’s rules.”

NWMLS also stated that it “has no legal obligation” to promote Compass listings.
