Compass clients seek class-action lawsuit against NWMLS

A new website encourages home sellers in Washington state to join a potential class-action lawsuit against the Northwest Multiple Listing Service (NWMLS).

While Compass isn’t explicitly named as the creator, the site notes that Compass clients “believe they were damaged by the current rules and practices of NWMLS.” The page’s Terms of Service and Privacy notices also link back to Compass, Inman reported.

The website, titled Washington Homeowner Rights, posits that “Washington state homeowners deserve the same freedom as everyone else” and outlines reasons NWMLS policies have allegedly caused sellers to lose out on profits, saying, “We are helping our clients coordinate across a group of injured homesellers and helping the group secure counsel to bring legal action against NWMLS and its Board and to pursue full recovery for lost home value.”

This plaintiff solicitation comes right after NWMLS President and CEO Justin Haag issued a statement in support of the National Association of REALTORS’® Clear Cooperation Policy.

Washington Homeowner Rights, meanwhile, says that the policy harms sellers whose homes underwent a price drop or stayed on the market longer than expected, while disregarding their right to privacy.

“In every other state, homeowners have the freedom to explore alternative off-MLS marketing strategies that protect value, privacy and flexibility,” the site said. “In Washington, that freedom doesn’t exist — and sellers are paying the price.”
